The chances are that if you are a property owner, an animal owner, a farmer, a pool owner, a construction company or just about anyone wanting to avoid a personal injury lawsuit, yes you do need a fence. Think of fence as a defense. If someone is injured on your property, at a construction site, on your farm or by your animal you may well be liable for their injury. Fences make good sense when you need to protect your self and others.

Construction sites generally have strict regulations regarding fencing. Depending on the site itself a simple fence can be enough to stop any personal injury claims being laid. Sometimes though, young (or older) people will break through a fence, just because they can. In these cases, warning signs are usually enough to prevent a personal injury claim being made. If there is a large hole in the fence though, or it is too loose at the bottom or top a child may be injured and another party may have a viable case to bring. Most construction companies are well aware of the risks involved, but it only takes one slip-up to be facing a lawsuit.

Pool owners are usually also under strict regulations which can vary from state to state. Fencing around pools is absolutely essential for the safety of children, whether they are wandering or not. Sometimes it can be difficult to find a level of security that keeps people out but does not in itself pose a danger. If you have a large pool, there is often temptation for young people to get in. This leads some people into erecting fences that have barbed wire or spikes. Be sure to erect plenty of visible warning signs if you don’t want to be held liable for some teenager getting them selves spiked.
